gatherologie™ Cancellation Policy

FOR CANCELLATION BY PLANNER

 

The Planner may cancel its reservation in accordance with the following terms, according to the cancellation policy chosen by The Lister.

  1. Processing Fee:gatherologie charges The Lister a processing fee (currently 3%) for processing transaction, in addition to any commission gatherologie may take from payments made for reservations. The gatherologie processing fee of 3% is non-refundable.
  2. How to provide notification of cancellation:A reservation is officially canceled once gatherologie receives your cancelation request at the email address: info@gatherologie.com
  3. Cancellation Policy:gatherologie allows The Lister to choose among three cancellation policies:
    1. Flexible:Cancellations may be made by The Planner up to 3 business days prior to the Event Date. The Lister shall refund the entire Listing Fee if cancellation is made by The Planner during the foregoing period, except for gatherologie processing fees of 3% which are non-refundable; or
    2. Moderate:Cancellations may be made by The Planner up to 30 days prior to the Event Date. The Lister shall refund the entire Listing Fee if cancellation is made by The Planner during the foregoing period, except for gatherologie processing fees of 3% which are non-refundable; or
    3. Strict:Cancellations may be made by The Planner up to 90 days prior to the Event Date. The Lister shall refund the 50% of the Listing Fee if cancellation is madeThe Planner during the foregoing period, except for gatherologie processing fees of 3% which are non-refundable

PLANNER WILL NOT BE ENTITLED TO ANY REFUND IN RESPECT OF CANCELLATIONS MADE NOT IN ACCORDANCE WITH THE CHOSEN CANCELLATION POLICY.

  1. Dispute Resolution:Any dispute, controversy or claim arising out of or relating to this cancellation policy, including the formation, interpretation, breach or termination thereof, including whether the claims asserted are arbitrable, will be referred to and finally determined by arbitration in accordance with the JAMS International Arbitration Rules. The tribunal will consist of one arbitrator. The place of arbitration will be the city of San Luis Obispo. The language to be used in the arbitral proceedings will be English. Judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

 

FOR CANCELLATION BY THE LISTER

 

The Lister may cancel a reservation of its Space for an Event in accordance with the following terms:

  1. Processing Fee:gatherologie charges The Lister a processing fee (currently 3%) for processing transaction, in addition to any commission gatherologie may take from payments made for reservations. The gatherologie processing fee of 3% is non-refundable.
  2. How to provide notification of cancellation:A reservation is officially canceled once gatherologie receives your cancelation request at the email address: info@gatherologie.com
  3. Cancellation Fee:The Lister who cancels a reservation less than 30 days prior to the Event Date will be charged a $50 cancellation fee in addition to the amount of the processing fee paid by The Planner (which gatherologie may refund to the The Planner in its discretion). The Lister can only cancel any Event or booking once in any six month period. We will automatically deduct any applicable cancellation fee or processing fee for which you are responsible, from the next payout.
  4. Unavailable/Blocked calendar:Your calendar will stay blocked for the cancelled Event Date and you will not be able to accept another reservation for the same dates of the canceled reservation.
  5.
